A Comparative Study of Civil Disobedience in the Opinions of Seyyed Kazem Hosseini Haeri and Ronald Dworkin

Abstract

It is necessary to analyze and compare the opinions of scholars of contemporary Muslim societies that have taken a step towards modernity and use its manifestations and mechanisms to organize their public affairs and regulate and delimit the political realm with the opinions of scholars of modern Western governments - in order to develop increasing cultural exchanges and political interactions. In the last century, protesting against the deviation of sovereignty from the aspects of representation and the establishment of unjust laws that violate the fundamental rights of citizens has become an effective and transformative mechanism in modern societies in a non-violent and conscious manner. This way of confronting sovereignty in order to control the governance policy and the actions resulting from it, which has been interpreted as "civil disobedience" and has sometimes been elevated to the level of a legal and moral right, has been the subject of discussion and examination by scholars, political circles, as well as politicians and policymakers of democratic systems. The purpose of this article is to examine this issue from the perspective of two scholars in the Islamic and Western traditions; Namely, Seyyed Kazem Hosseini Haeri is an Iranian jurist and thinker and Ronald Dworkin is an American legal philosopher. The research method is descriptive-analytical and comparative. The findings of this research show that despite the widespread acceptance of the subject in Western society and its thinkers, with a significant difference in the basis and restrictions in the scope and territory, the right to civil disobedience has been accepted in the context of Shiite religious thought in general and Seyyed Kazem Haeri's view in particular.
