A Comparative Study of the Conception and Paradigms of Judicial Governance within the Legal Systems of Iran and the European Union

Abstract

Judicial governance, as one of the cardinal pillars of legal systems, plays a pivotal role in safeguarding justice and vindicating human rights. The public power of the judiciary, as an independent adjudicative institution, bears the responsibility for statutory enforcement, the redress of citizens' rights, and the protection of fundamental entitlements. Judicial governance constitutes an executive instrument and a key element in sustainable development and the realization of citizenship rights, encompassing a spectrum of functions and roles that profoundly influence the judicial apparatus. This concept pertains to the commissioning of judges, the imposition of disciplinary sanctions, the administration and financing of the judiciary, and the preservation of its independence and efficacy. Utilizing a descriptive-analytical method grounded in a comparative approach and library-based research, this study examines the nature and paradigms of judicial governance within the legal systems of Iran and the European Union. The primary finding of this research indicates that judicial governance is emerging as a preeminent subject of political and legal discourse globally, categorized into four models: the Ministry of Justice, Court Services, the Judicial Council, and the Centralized-Islamic Justice model; the Iranian judicial system is classified under the latter.
