A Critical Explication of Heidegger’s Ontological Approach Regarding the Necessity of Social Responsibility within Public Law Framework

Abstract

Martin Heidegger, a prominent philosopher of the twentieth century, advanced a distinctive perspective through his theory of ontology (Ontologie), according to which the concept of Being (Sein) constitutes the fundamental dimension of human existence. Heidegger places particular emphasis on the concept and conceives the human being (Dasein) as an entity that dwells within an existential world. Within Heideggerian ontology, all phenomena are to be understood through the lens of Being itself. Although Heidegger did not directly address questions of public law, the application of his ontological approach has significant implications for the concept of social responsibility within the philosophy of public law. The present study seeks to answer the following question: how may Heidegger’s ontological approach be appraised in the context of the necessity of social responsibility within the philosophy of public law? Accordingly, the study aims at both an explication and a critique of this approach. Employing a descriptive-analytical methodology, the study demonstrates that Heidegger understands the human being as an entity existing within the world while simultaneously perceiving itself as independent from that world. However, the human being may not be conceived merely as an isolated and autonomous individual without due consideration of the social and cultural factors that shape personal identity. The study concludes that Heidegger’s emphasis on individuality and being may lead to forms of isolationism and neglect of social responsibilities. A dogmatic application of Heideggerian ontology within the framework of public law philosophy ultimately risks producing human alienation and estrangement from the social sphere
