Security under the Iranian Constitution as a Constraint on the Powers of the Supreme Administrative Council and a Basis for Judicial Review by the Court of Administrative Justice

Abstract

Security in the legal system of the Islamic Republic of Iran is a multidimensional and cross-sectoral concept that finds expression in the Constitution, particularly in the forms of “judicial security,” “national security,” and “economic security.” Moving beyond a merely descriptive approach to the dimensions of security, this study seeks to demonstrate that, in the sphere of public and administrative law, these concepts perform a function that extends beyond general policy declarations and operate as a legal framework constraining the powers of administrative institutions, particularly the Supreme Administrative Council in reforming the structure of executive bodies. The principal question is how the constitutional dimensions of security determine the limits of the Council’s competence and provide a basis for judicial review by the Court of Administrative Justice. Employing an analytical method and drawing upon ordinary legislation, particularly the Civil Service Management Act, as well as the decisions of the Court of Administrative Justice, the study argues that the concepts of security provide the Court with substantive standards by which to assess, and where necessary annul, structural decisions of the Council that may prejudice “judicial security” through interference with employees’ vested rights, “economic security” through disruption of planning stability, or “national security” through changes affecting high-stake institutions. The findings indicate that, viewed through this security-based framework, the Court’s jurisprudence has directed the exercise of the Council’s powers within the bounds of legality and has prevented structural reform from becoming an instrument for extra-legal action
