Decentralization Deferred: Legal and Structural Challenges to Provincial Councils in Iran and Iraq

Abstract

practical realization through the provincial council remains fraught with legal and structural challenges. This article poses the following central question: What are the principal legal challenges confronting local decentralization, as embodied by the provincial council, in Iraq and Iran? Employing a descriptive-analytical-comparative methodology, the study systematically examines the constitutional and statutory frameworks of both jurisdictions. The findings reveal several significant conclusions. First, the constitutional and legal architecture of each country, particularly the unitary structure of Iran versus the federal, composite structure of Iraq, fundamentally shapes the scope and efficacy of local governance. Second, notwithstanding formal constitutional recognition, the powers vested in provincial councils remain demonstrably weak relative to the formidable authority retained by central governments in both states. Third, despite historical, cultural, and legal commonalities, the provincial councils of Iran and Iraq are not functionally analogous; their points of divergence substantially outweigh their limited similarities. Fourth, and most critically, both countries exhibit a pattern of "constitutional atrophy," whereby the progressive potential enshrined in constitutional provisions regarding local governance has been significantly eroded by subsequent ordinary legislation. In Iraq, this manifests in legislative retreats from federalist ideals; in Iran, it reflects the historically centralized nature of the state, which subordinates provincial councils to the administrative apparatus of the central government. The article concludes that meaningful reform must confront these deep-seated political and institutional dynamics rather than rely on mere legal adjustments.
