The current crisis of law, beyond mere norm violation, bears an existential character that must be termed the “suspension of the horizon of rule-governed order”—a condition in which law has lost its efficacy as an instrument for ordering collective life and the structure of the state. Adopting a critical approach, this study demonstrates that the prevailing methodologies in legal science (positivism, normativism, and interpretivism), owing to their reliance on the presupposition of the “stability of order,” prove ineffective in confronting this threshold situation, and they either overlook the vital actions necessary for the survival of order or drive them into the domain of naked force. To move beyond this impasse, the article formulates the concept of the “constituent act of law”—an act that, under conditions of the suspension of order, emerges from the concrete situation prior to any reliance on the text of the law, and through the “interpretation of the foundation” and the reconstruction of “political unity,” furnishes the possibility for the regeneration of the rule. Finally, by introducing a “constituent methodology,” a model is presented in which the jurist, by moving beyond legal formalism and accepting ontological responsibility for the “condition of possibility of law,” as a constituent subject, prevents the disintegration of the institutional order.
