صیانت از حقوق بشر در پرتو قانون هوش مصنوعی اتحادیه اروپا؛ خوانشی تطبیقی بر پایه مبانی فقه امامیه

چکیده

گسترش هوش مصنوعی، حمایت از حقوق بشر را با صورتی تازه از قدرت فناورانه روبه‌رو کرده است؛ قدرتی که الزاماً از مسیر اجبار آشکار عمل نمی‌کند، بلکه از راه گردآوری داده، پیش‌بینی الگوریتمی، رتبه‌بندی، توصیه‌گری، تولید محتوا و تصمیم‌سازی خودکار، به‌تدریج بر زیست فردی و اجتماعی انسان اثر می‌گذارد. از این منظر، مسئله اصلی مقاله آن است که در برابر این مداخله‌های نامحسوس اما مؤثر، چگونه می‌توان از کرامت انسانی، حریم خصوصی، برابری، آزادی بیان، دسترسی به اطلاعات و حق کار صیانت کرد. این پژوهش با رویکردی توصیفی ـ تحلیلی و تطبیقی، قانون هوش مصنوعی اتحادیه اروپا را به‌مثابه نمونه‌ای از تنظیم‌گری حقوق‌بنیاد بررسی می‌کند و هم‌زمان، مبانی فقه امامیه را برای سنجش مشروعیت سامانه‌های هوش مصنوعی بازخوانی می‌نماید. یافته‌ها نشان می‌دهد میان منطق خطرمحور این قانون و اصولی چون کرامت انسان، عدالت، نفی سلطه ناموجه، منع مداخله در شئون خصوصی و مسئولیت حاکمیت در دفع ضرر، هم‌گرایی معناداری وجود دارد. این هم‌گرایی در الزاماتی مانند مدیریت ریسک، کیفیت داده، شفافیت، نظارت انسانی، پاسخگویی و امکان اعتراض آشکار می‌شود. بر این اساس، حمایت از حقوق بشر در عصر هوش مصنوعی نباید در سطح اعلام ارزش‌ها باقی بماند، بلکه باید به تکالیفی نهادی، قابل نظارت و قابل پیگیری تبدیل شود. نتیجه مقاله آن است که مشروعیت حکمرانی هوش مصنوعی نه صرفاً با کارآمدی فنی یا سودآوری اقتصادی، بلکه با توان آن در پاسداشت انسان، مهار قدرت الگوریتمی و تضمین مسئولیت‌پذیری فناورانه سنجیده می‌شود.

Protecting Human Rights in Light of the European Union Artificial Intelligence Act: A Comparative Reading Based on the Foundations of Imami Jurisprudence

The expansion of artificial intelligence has confronted human rights protection with a new form of technological power. This power does not necessarily operate through overt coercion; rather, it gradually shapes individual and social life through data collection, algorithmic prediction, ranking, recommendation, content generation, and automated decision-making. From this perspective, the central question of this article is how human dignity, privacy, equality, freedom of expression, access to information, and the right to work can be protected against such invisible yet consequential forms of intervention. Adopting a descriptive-analytical and comparative approach, this study examines the European Union Artificial Intelligence Act as a rights-oriented model of regulation and, at the same time, revisits the foundations of Imami jurisprudence as a normative basis for assessing the legitimacy of AI systems. The findings indicate a meaningful convergence between the risk-based logic of the Act and principles such as human dignity, justice, the rejection of unjustified domination, the prohibition of interference in private affairs, and the responsibility of governance to prevent harm. This convergence is reflected in requirements concerning risk management, data quality, transparency, human oversight, accountability, and the possibility of contestation. Accordingly, the protection of human rights in the age of artificial intelligence must not remain at the level of declaratory values; it should be translated into institutional, reviewable, and enforceable obligations. The article concludes that the legitimacy of AI governance should not be measured merely by technical efficiency or economic utility, but by its capacity to protect the human person, restrain algorithmic power, and secure technological accountability.
