چکیده
تازه های تحقیق
پژوهش حاضر با کاربست چارچوب تحلیلی سه سطحی نشان داد که پارادایم لیبرالمشارکتی، مسئلهٔ تخصیص منابع عمومی را از یک پرسش ماهوی درباره خیر به یک پرسش فرآیندی درباره طراحی نهادها تبدیل میکند. در این گذار، منفعت عمومی دیگر یک آرمان ذاتی یا حقیقت عینی نیست، بلکه به یک دال سیال یا متغیر وابسته بدل میشود که محتوای آن همواره در حال ساختهشدن و برساخته شدن است. این محتوا در میدان نهادی رقابتی و از خلال برهمکنش سه منطق مسلط پر میشود: منطق اکثریت و سیاست (در قوه مقننه)، منطق کارایی و تخصص (در نهادهای تنظیمگر) و منطق حق و محدودیت (در دستگاه قضائی). مشخصهٔ بارز این روایت، دو اولویت قاطع است.
نخست، تقدم فرآیند بر محتوا که در آن مشروعیت یک تصمیم بیش از صحت ذاتیاش، به صحت روش اتخاذش وابسته است؛ دوم، تقدم حق فردی (بهمثابه حداقل مشترک اخلاقی غیرقابل تقلیل ) بر ادعاهای فایدهبنیاد جمعی. قدرت این الگو در عقلانیسازی قدرت، مهار نهادینه شدهٔ خودکامگی و ایجاد فضایی برای تکثر و اصلاحپذیری است.
نتیجه نهایی این معماری آن است که منفعت عمومی لیبرال یک حقیقت کشف شده نیست، بلکه برندهٔ موقت یک بازی دائمی نهادی است که قاعدهٔ اصلی آن، منع انحصار و الزام به استدلال است. مطلوبیت آن در فرآیند بازی، یعنی در قابلیت اصلاحپذیری، مهار نهادینهشدهٔ قدرت و پاسداری بنیادین از استقلال اخلاقی فرد، نهفته است.
بااینحال، نقطه ضعف ذاتی و تراژیک این الگو در همین جاست. قواعد این بازی عادلانه (فردگرایی، برابری صوری، کارایی) خود میتوانند به ابزارهای ایدئولوژیک بازتولید نابرابری تبدیل شوند؛ بازیای که در آن وزن استدلال ثروتمند به دلیل تمایل به پرداخت بالاتر، سنگینتر است؛ بازیای که در آن اکثریت میتواند با رعایت فرآیند، منافع اقلیت را نادیده بگیرد و بازیای که در آن حقوق از دفاع در برابر فقر ساختاری و نابرابری سیستماتیک عاجز است.
پارادایم لیبرال درنهایت، فاقد رتوریک و ابزار لازم برای شناسایی ریشههای این نابرابریها و ارائه پاسخی رادیکال به آنها است. بنابراین منفعت عمومی برساخته شده در این میدان میتواند و اغلب، تصویر تحریف شدهای از خیر جمعی باشد که آینه روابط قدرت موجود است، نه نقادی آن. این پارادوکس لیبرالیسم است. نظامی که برای آزادی و مهار قدرت بنا شد، میتواند ظریفترین و مشروعترین شکل سلطه را دامن زند.

Drawing upon a public finance law approach and employing a novel tripartite analytical framework of "conceptualization, institutionalization, operationalization," the present study seeks to explicate the dialectic among the dominant legal-ideological strata, the institutional configuration, and the executive mechanisms of public resources allocation, with an emphasis on the public interest within the liberal-participatory governance system. The research hypothesis rests on the proposition that an analysis of the public interest which fails to disaggregate the levels of "concept, institution, and operation" engenders a fallacy of understanding, for each governance paradigm bridges the gap between theoretical ideals and allocative realities through a systematic nexus among these three levels. The research question asks: upon which ontological-epistemological logic does the liberal-participatory paradigm (with the governance system of the United States as a case study) conceptualize the public interest, within which structure does it institutionalize it, and through which legal-administrative instruments does it render it operational? It appears that within this paradigm, the public interest is conceptualized as the aggregated preference of individuals, grounded in methodological individualism; institutionalized within a distributed and competitive structure; and operationalized through procedural rationality - a characterization whereby justice inheres not in the outcome but in the equitable observance of the rules of the game. Moving beyond purely descriptive-normative approaches, the present study, aimed at filling this lacuna, applies the tripartite analytical framework in order to lay bare the logic of power latent behind every claim invoking the public interest. This model enables us to capture contradictions - for instance, where the "concept" is just, yet the "institution" that interprets it expropriates it in favor of an unjust "operation." The novelty of this study lies in the shift from the substantive question "What is the public interest?" to the procedural question "Who constructs it, and how?" The ultimate aim of the study is not to offer yet another normative criterion, but to furnish a robust instrument for the requisite scrutiny of power in the realm of governance over public resources.
