بازاندیشی مشروعیت قانون اساسی در پرتو خوانش‌های یورگن هابرماس و الساندرو فرارا

چکیده

یکی از تنش‌های بنیادین در حقوق اساسی، قدرت مؤسس است که معمولاً به لحظه بنیان‌گذاری و اراده نسل مؤسس گره می‌خورد، درحالی‌که عدالت بین‌نسلی، مشروعیت قانون اساسی را در افق زمان می‌سنجد و آن را نسبت به حقوق و آزادی‌های نسل‌های آینده مسئول می‌داند. مسئله اصلی آن است که اگر قانون اساسی بر رضایت تاریخی بنیان‌گذاران تکیه کند، چگونه می‌تواند هم‌زمان ادعای خودآیینی مردم امروز و تعهد به حفاظت از امکان‌های آزادی برای فردا را توجیه کند؟ هدف پژوهش حاضر، بازاندیشی مشروعیت قانون اساسی در پرتو تنش میان دو منطق نظری است؛ از یک‌سو، منطق هابرماسیِ مشروعیت رویه‌ای که اعتبار قانون اساسی را به خودآیینی دموکراتیک، مشارکت عمومی و فرایندهای ارتباطی خلق هنجار پیوند می‌دهد و از سوی دیگر، منطق فراراییِ حاکمیت توالی‌مند که بر محدودیت‌های بین‌نسلی قدرت اصلاح قانون اساسی تأکید دارد. روش تحقیق، تحلیل مفهومی‌هنجاری و تفسیر متون نظری است. یافته مقاله حاضر، پیشنهاد الگوی قدرت مؤسس بین‌نسلی است که بر اساس آن، مشروعیت قانون اساسی، نتیجه یک فرایند پیوسته خودبنیاد دموکراتیک است که باید در عین فراهم کردن امکان اصلاح، به قیدهای معقولیت بین‌نسلی و حفاظت از آزادی‌های آینده پایبند بماند.

تازه های تحقیق

نوشتار حاضر از یک تنش کلاسیک در حقوق اساسی آغاز کرد؛ قدرت مؤسس غالباً به لحظه بنیادگذاری و اراده نسل مؤسس گره می‌خورد، درحالی‌که عدالت بین‌نسلی مشروعیت را در افق زمان می‌سنجد. پرسش اصلی آن بود که اگر قانون اساسی بر رضایت تاریخی بنیان‌گذاران تکیه کند، چگونه می‌تواند هم‌زمان ادعای خودقانون‌گذاری مردم امروز را حفظ کند و از سوی دیگر، آینده را با تصمیم‌های سنگین و برگشت‌ناپذیر از پیش مقید نسازد. قدرت مؤسس باید چگونه بازفهم شود تا پایداری قانون اساسی به معنای سلطه گذشته بر حال یا مصادره آینده به دست حال تفسیر نشود، بلکه به‌عنوان سازوکاری برای تضمین استمرار آزادی‌ها و امکان‌های تصمیم‌گیری در طول زمان فهم گردد.

بر پایه بازسازی انتقادی تنش میان این دو منطق، الگوی قدرت مؤسس بین‌نسلی پیشنهاد شد. این الگو در پی آن نیست که قدرت مؤسس را به یک امر صرفاً تاریخی تقلیل دهد یا آن را به دست اراده اکثریت هر لحظه بسپارد؛ بلکه می‌کوشد آن را به صورت نوعی خودبنیادی پیوسته و مسئول بازسازی کند. در این برداشت، مشروعیت قانون اساسی حاصل یک فرایند ممتد است که در آن، از یک طرف، مسیرهای مشارکتی و ارتباطی بازمی‌ماند تا مردم زنده بتوانند نسبت خود با قانون اساسی را بازتولید کنند و از طرف دیگر، همین فرایند با قیدهای معقولیت بین‌نسلی مهار می‌شود تا تصمیم‌های امروز، ظرفیت خودتعیین‌گری فردا را از درون تهی نسازد.

دستاورد مرکزی این الگو برای نظریه تغییر قانون اساسی، بازتعریف مرز بازنگری و جایگزینی ماهوی است. معمولاً گفته می‌شود قدرت اصلاح یک قدرت برساخته است و نمی‌تواند بی‌قیدوشرط به سطح قدرت مؤسس ارتقا یابد؛ اما مدل حاضر نشان می‌دهد که این مرز فقط با معیارهای شکلی یا حتی صرفاً محتوایی روشن نمی‌شود، بلکه یک معیار زمانی‌هنجاری نیز لازم دارد. هر اصلاحی که به نحو ساختاری مسیرهای بازاندیشی را برای نسل‌های بعد مسدود کند، یا هزینه‌های برگشت‌ناپذیر را به‌گونه‌ای منتقل سازد که آینده ناچار شود آزادی‌های خود را برای جبران تصمیم‌های امروز محدود کند، عملاً از قلمرو بازنگری عبور کرده و به تصمیم مؤسس پنهان نزدیک می‌شود حتی اگر در ظاهر، برچسب اصلاح داشته باشد. به همین دلیل، مرز بازنگری یا جایگزینی باید در پرتو حفاظت از ظرفیت آزادی آینده و حفظ امکان بازگشت و تصحیح دوباره تعریف شود.

درنهایت می‌توان دو حق خودقانون‌گذاری شهروندان حاضر و حق حفاظت از چشم‌انداز آزادی شهروندان آینده را در یک طراحی هنجاری واحد گرد آورد. این هم‌نشانی فقط زمانی ممکن است که مشروعیت، هم رویه‌ای و بازتولیدپذیر فهم شود و هم اعمال قدرت اصلاح به قیدهای معقولیت بین‌نسلی، بازگشت‌پذیری معنادار و حفظ ظرفیت خودتعیین‌گری آینده مقید گردد. برآیند نهایی آن است که مشروعیت قانون اساسی در افق بین‌نسلی با ترکیب دو اصل به دست می‌آید: بازتولیدپذیری مشروعیت از مسیر رویه‌های مشارکتی و ممنوعیت برگشت‌ناپذیری زمانی که ظرفیت خودتعیین‌گری آینده را تهی می‌کند.

 One of the fundamental tensions in constitutional law concerns constituent power, which is traditionally associated with the founding moment and the will of the founding generation, whereas intergenerational justice evaluates constitutional legitimacy across time and holds it accountable to the rights and freedoms of future generations. The central question is how a constitution that relies on the historical consent of its founders can simultaneously justify the democratic self-legislation of the present people and the obligation to preserve the conditions of freedom for the future. This article rethinks constitutional legitimacy through the tension between two theoretical logics: Habermas’s procedural account of legitimacy, which links constitutional validity to democratic autonomy, public participation, and communicative processes of norm production; and Ferrara’s account of sequential sovereignty, which emphasizes intergenerational constraints on the power of constitutional amendment. The research adopts a conceptual-normative method and an interpretive analysis of theoretical texts. The article argues that intergenerational constraints can be justified only if they are reconstructed not as external substantive limits on democratic will, but as conditions for preserving democratic self-legislation across time. Its main finding is the model of intergenerational constituent power, according to which constitutional legitimacy is an ongoing democratic process that must preserve both the possibility of constitutional amendment and the future capacity for collective self-determination.
