چکیده

«حقوق عمومی» نظام حقوقی ناظر بر «حکمرانی» است که سه خصلت «تنظیمی»، «هنجاری» و «بومی-جهانی» دارد. تنظیم‌ِ به‌سامانِ روابط، مستلزم شناخت آن است. شناختی که درون حصارهای رشته‌ای و به صرفِ هنجارشناسی حقوقی ممکن نیست. بایدها و نبایدهای حقوقی ازیک‌سو ریشه در سنت‌های جوامع و ازسوی‌دیگر در پیوند با اقتضائاتِ عصر جدید شکل می‌گیرد اما فهم «سنت» و شناختِ «تجدد» نیز در چارچوب‌های بستة یک رشتة دانشگاهی مقدور نیست. براین‌بنیاد، بین دانش‌های «حقوق» و «مدیریت» و «سیاست» شبکة معناداری از مفاهیم و نظریه‌ها متولد می‌شود که رشته‌های آموزشی این حوزه‌ها را نیز با یک‌دیگر آمیخته و مطالعات میان‌رشته‌ای حکمرانی را خلق می‌کند. براین‌اساس، این مقاله با رویکردی میان‌رشته‌ای و با روشِِ تحلیلِ تطبیقی در پی توصیف برنامه‌های آموزشی دانشگاه‌های هاروارد، پنسیلوانیا و آکسفورد از منطقة آیوی لیگ و آکسبریج و استنباط ملاک برای تبیینِ مقایسه ای چگونگی تحقق مطالعات حکمرانی است. بربنیادِ نتایجِ این بررسی الگوی مطلوب آموزش حکمرانی بر سه رویکرد استوار است: رویکرد میان‌رشته‌ای که در آن قانونگذاری با رویکردی اجتماعی و درصدد تعادل‌بخشی به نیروهای متضادِ جامعه است،

رویکردِ مسأله‌محور، که در این چارچوب نظریه «زمینه‌بنیاد» و ظهوریافته از شواهد جامعه است که در بستری اجتماعی و برخاسته از یک/چند مسأله شکل گرفته است و رویکرد تجربی و مبتنی بر شواهد که در آن «مطالعات حکمرانی» بر پایۀ فهمِ روش‌مندِ «واقعیت» استوار شده و به «چگونگی»‌ جامعه‌پذیری قانون و کارآمدی حکمرانی جواب می‌دهد.

A Comparative Study of Governance Studies Education A Case Study of Harvard, the University of Pennsylvania, and the University of Oxford

Public law constitutes the legal framework governing governance and is characterized by three defining attributes: regulatory, normative, and glocal (local–global) dimensions. The effective regulation of public relationships presupposes a comprehensive understanding of governance itself—an understanding that cannot be attained solely through the disciplinary boundaries of legal scholarship or by relying exclusively on doctrinal legal analysis.

Against this backdrop, a meaningful intellectual nexus emerges among the disciplines of law, public management, and political science, generating a shared body of concepts, theories, and analytical frameworks that transcend conventional disciplinary boundaries and give rise to the interdisciplinary field of Governance Studies. Adopting an interdisciplinary perspective and employing a comparative analytical methodology, this study examines the educational programs in Governance Studies at Harvard University, the University of Pennsylvania, and the University of Oxford, representing leading institutions within the Ivy League and Oxbridge traditions. The study seeks to identify the defining characteristics of governance education through a comparative analysis of their curricula and to derive analytical criteria for conceptualizing an effective model of Governance Studies education. The findings indicate that an optimal model of Governance Studies education rests upon three interrelated foundations. First, it embraces an interdisciplinary approach, in which law is understood as a socially embedded institution and legislation is conceived as a mechanism for balancing competing societal interests rather than merely regulating legal relationships. Second, it adopts a problem-oriented approach, whereby governance theories are developed through grounded, evidence-informed inquiry and emerge from the analysis of concrete public problems within their specific social contexts. Third, it relies on an empirical, evidence-based approach, in which Governance Studies are grounded in the systematic analysis of social reality and seek to explain the processes through which legal norms become socially institutionalized and governance arrangements achieve effectiveness.
