بحران‌پژوهی در تحقق حق بر تأمین اجتماعی به مثابه حق بشری در کشورهای در حال توسعه

چکیده

در منظومه حقوق بشر معاصر، تضمین عدالت اجتماعی و صیانت از کرامت انسانی بدون وجود نظامی کارآمد از حمایت‌های اجتماعی ممکن نیست. از همین منظر، حق بر تأمین اجتماعی به‌عنوان یکی از حقوق بنیادین بشر در اسناد بین‌المللی شناخته شده و دولت‌ها را مکلف به حمایت از افراد در برابر مخاطرات اقتصادی و اجتماعی ساخته است. با این حال، در کشورهای در حال توسعه، تحقق این حق با موانع متعددی روبه‌روست؛ از جمله ضعف زیرساخت‌های نهادی، کمبود منابع مالی، ناکارآمدی نظارت‌های بین‌المللی و تأثیر سیاست‌های اقتصادی نهادهایی چون صندوق بین‌المللی پول و بانک جهانی بر ظرفیت اجرایی دولت‌ها. واکاوی این چالش‌ها نشان می‌دهد که فاصله میان شناسایی هنجاری و اجرای عملی این حق، ریشه در نبود ضمانت‌های الزام‌آور و نابرابری ساختاری در نظام مالی جهانی دارد. پژوهش حاضر با روش توصیفی–تحلیلی و در پرتو موازین حقوق بین‌الملل بشر، ابعاد مفهومی و نهادی این حق را بررسی کرده و بر لزوم بازاندیشی در پیوند میان سیاست‌های اقتصادی جهانی و تعهدات حقوق بشری در راستای تحقق مؤثر حق بر تأمین اجتماعی تأکید می‌ورزد.

چکیده [English]

In the contemporary human rights system, ensuring social justice and protecting human dignity is not possible without an efficient system of social protection. From this perspective, the right to social security is recognized as one of the fundamental human rights in international documents and has obliged governments to protect individuals against economic and social risks. However, in developing states, the realization of this right faces numerous obstacles; Including weak institutional infrastructure, lack of financial resources, ineffective international supervision and the impact of economic policies of institutions such as the International Monetary Fund and the World Bank on the executive capacity of governments. Analysis of these challenges shows that the gap between normative recognition and practical implementation of this right is rooted in the lack of binding guarantees and structural inequality in the global financial system. The present study, using a descriptive-analytical method and in light of international human rights standards, examines the conceptual and institutional dimensions of this right and emphasizes the need to rethink the link between global economic policies and human rights obligations in order to effectively realize the right to social security.
