بحران‌پژوهی در تحقق حق بر تأمین اجتماعی به‌مثابه حق بشری در کشورهای درحال‌توسعه

چکیده

در منظومه حقوق بشر معاصر، تضمین عدالت اجتماعی و صیانت از کرامت انسانی بدون وجود نظامی کارآمد از حمایت‌های اجتماعی ممکن نیست. از همین منظر، حق بر تأمین اجتماعی به‌عنوان یکی از حقوق بنیادین بشر در اسناد بین‌المللی شناخته شده و دولت‌ها را مکلف به حمایت از افراد در برابر مخاطرات اقتصادی و اجتماعی ساخته است. بااین‌حال در کشورهای درحال‌توسعه، تحقق این حق با موانع متعددی روبه‌روست؛ ازجمله ضعف زیرساخت‌های نهادی، کمبود منابع مالی، ناکارآمدی نظارت‌های بین‌المللی و تأثیر سیاست‌های اقتصادی نهادهایی چون صندوق بین‌المللی پول و بانک جهانی بر ظرفیت اجرایی دولت‌ها. واکاوی این چالش‌ها نشان می‌دهد که فاصله میان شناسایی هنجاری و اجرای عملی این حق، ریشه در نبود ضمانت‌های الزام‌آور و نابرابری ساختاری در نظام مالی جهانی دارد. پژوهش حاضر با روش توصیفی‌تحلیلی و در پرتو موازین حقوق بین‌الملل بشر، ابعاد مفهومی و نهادی این حق را بررسی کرده و بر لزوم بازاندیشی در پیوند میان سیاست‌های اقتصادی جهانی و تعهدات حقوق بشری در راستای تحقق مؤثر حق بر تأمین اجتماعی تأکید می‌ورزد.

تازه های تحقیق

بررسی جایگاه حق بر تأمین اجتماعی در نظام بین‌المللی حقوق بشر نشان می‌دهد که این حق، اگرچه از پشتوانه هنجاری مستحکمی در اسناد جهانی برخوردار است، اما در سطح اجرا با خلأهای ساختاری و نهادی مواجه می‌باشد. فقدان سازوکارهای الزام‌آور برای تأمین مالی و نظارت مؤثر بر تعهدات دولت‌ها، موجب شده است که این حق در حد یک تعهد اخلاقی یا برنامه‌ای باقی بماند و از کارکرد واقعی خود در تضمین عدالت اجتماعی فاصله گیرد. از حیث حقوقی، وضعیت کنونی بیانگر تعارض میان دو منطق در نظام بین‌الملل است: منطق اقتصادی مبتنی بر ثبات مالی و منطق حقوقی مبتنی بر کرامت انسانی.

 این تعارض در عمل باعث شده که الزامات اقتصادی جهانی، به‌ویژه در سیاست‌های نهادهای مالی بین‌المللی، بر تعهدات حقوق بشری دولت‌ها غلبه یابد و زمینه تضعیف نظام‌های ملی تأمین اجتماعی را فراهم آورد. در چنین ساختاری، حق بر تأمین اجتماعی نه به‌عنوان الزام حقوقی، بلکه به‌مثابه آرمانی وابسته به توان اقتصادی دولت‌ها تفسیر می‌شود. تأمل در این روند نشان می‌دهد که دستیابی به توازن میان ضرورت‌های اقتصادی و تعهدات حقوقی، نیازمند بازتعریف رابطه میان حاکمیت اقتصادی دولت‌ها و مسئولیت فراملی آنان در قبال تحقق حقوق بشر است تا زمانی که این توازن در قالب قواعد الزام‌آور مالی و نظارتی شکل نگیرد، تحقق حق بر تأمین اجتماعی در سطح جهانی در معرض آسیب ساختاری باقی خواهد ماند و نظام حقوق بشر از ایفای نقش حمایتی خود در برابر نابرابری اقتصادی بازخواهد ماند.

جایگاه حق بر تأمین اجتماعی در نظام بین‌المللی حقوق بشر، اگرچه از حیث شناسایی هنجاری تثبیت شده است، اما در سطح اجرا همچنان در معرض کاستی‌های ساختاری قرار دارد. این کاستی‌ها ناشی از هم‌پوشانی عوامل داخلی و فراملی است که از یک‌سو ظرفیت‌های نهادی و مالی دولت‌ها را محدود می‌سازد و از سوی دیگر، با فقدان سازوکارهای الزام‌آور مالی و نظارتی در سطح بین‌المللی، امکان تحقق مؤثر این حق را تضعیف می‌کند. در چنین وضعیتی منطق غالب سیاست‌گذاری اقتصادی، بدون ادغام نظام‌مند الزامات حقوق بشری، موجب شده است که تأمین اجتماعی به حوزه‌ای تابع ملاحظات بودجه‌ای و سیاست‌های مقطعی فروکاسته شود و از جایگاه یک تعهد حقوقی قابل ارزیابی فاصله گیرد. در این چارچوب، برون‌رفت از وضعیت موجود مستلزم آن است که اجرای حق بر تأمین اجتماعی از سطح تعهدات کلی و غیر قابل سنجش به سازوکاری نهادی، شفاف و مبتنی بر داده‌های قابل اندازه‌گیری منتقل شود. استقرار نظام یکپارچهٔ داده‌های رفاه اجتماعی که امکان شناسایی دقیق گروه‌های مشمول، رصد جریان تخصیص منابع و ارزیابی مستمر کفایت و پوشش حمایت‌ها را فراهم آورد، می‌تواند مبنای عملی این گذار باشد. چنین سازوکاری، ضمن افزایش پاسخ‌گویی نهادهای مسئول، امکان سنجش میزان انطباق سیاست‌های مالی و اجتماعی با تعهدات حقوق بشری را ایجاد کرده و زمینه نظارت مؤثر داخلی و بین‌المللی بر تحقق حق بر تأمین اجتماعی را فراهم می‌سازد؛ امری که تحقق این حق را از سطح شناسایی صوری به سطح الزام اجرایی و قابل مطالبه ارتقا می‌دهد.

Within the contemporary human rights framework, the realization of social justice and the protection of human dignity are not possible without an effective system of social protection. From this perspective, the right to social security has been recognized as a fundamental human right in international instruments and imposes obligations on States to protect individuals against economic and social risks. In developing countries, however, the realization of this right faces numerous obstacles, including weak institutional infrastructure, limited financial resources, ineffective international monitoring, and the impact of the economic policies of institutions such as the International Monetary Fund and the World Bank on States’ implementation capacity. An examination of these challenges demonstrates that the gap between the normative recognition and practical implementation of this right is rooted in the absence of binding guarantees and structural inequality within the global financial system. Using a descriptive-analytical method and drawing on the standards of international human rights law, this study examines the conceptual and institutional dimensions of the right to social security and emphasizes the need to reconsider the relationship between global economic policies and human rights obligations with a view to ensuring the effective realization of this right.
